1. Introduction:
Welcome to Classic Painting & Construction. These Terms and Conditions govern the relationship between the customer (“Client”) and Classic Painting & Construction (“Company”) regarding the provision of painting, decorating, and construction services. By hiring our services, the Client agrees to be bound by the terms outlined below.
2. Services:
Classic Painting & Construction provides professional painting, decorating, and construction services for both interior and exterior projects. All work is performed by trained and certified professionals in accordance with industry standards and safety regulations.
3. Estimates and Quotes:
All in-home consultations are subject to a $150 fee for on-site assessments and detailed project evaluations.
This fee includes a comprehensive written quote that remains valid for 30 days. If the Client moves forward with Classic Painting & Construction on the project, the consultation fee will be fully credited toward the final quoted price.
Conversely, should the Client decide not to proceed after a detailed quote has been requested and provided, a $250 fee will be assessed to cover the administrative time spent.
4. Deposits and Payments:
A deposit of [insert percentage] may be required before work begins. The remaining balance is due upon completion of the project unless otherwise agreed in writing. All late payments are subject to a 3% charge and an additional 3% charge for each day thereafter.
5. Job Refusal and Safety Considerations:
Classic Painting & Construction reserves the right to refuse any job if it is deemed unsafe, unsanitary, or if conditions are unsuitable for proper execution. The Client is responsible for ensuring the site is accessible and free from hazards that may jeopardize the safety of our workers.
6. Project Cancellation and Termination Fees
6.1 General Cancellation. In the event that the Client cancels or terminates a project after the agreement has been executed and the project has been officially scheduled, the Client shall remain fully liable for the following costs incurred up to the date of cancellation:Material Costs: The full cost of all materials, supplies, and equipment already purchased for the project. Upon full payment of these costs by the Client, such materials shall be delivered to and become the property of the Client.
Administrative & Prep Expenses: Reasonable compensation for time spent by the Contractor on project quoting, estimating, and administration, alongside any travel expenses or mileage incurred prior to the formal notice of cancellation.
6.2 Minimum Cancellation Fee. Any cancellation under Section 6.1 shall be subject to a non-refundable, fixed administrative cancellation fee of $250.00, which shall be due and payable immediately upon cancellation.
6.3 Late Cancellation Penalty. If the Client cancels the project within forty-eight (48) hours of the scheduled project start date and time, the Client shall be liable to pay a late cancellation penalty equal to ten percent (10%) of the total estimated project contract value, or the $250.00 minimum cancellation fee outlined in Section 6.2, whichever amount is greater.
6.4 Purpose. The parties acknowledge and agree that the fees and penalties outlined in this Section 6 do not constitute a penalty, but rather a reasonable estimate of liquidated damages to fairly compensate the Contractor for lost scheduling opportunities, time, and resources committed to the project.
7. Client Responsibilities:
The Client must provide clear access to the work area, including removing furniture and personal items as necessary. The Client must ensure that any necessary permits or approvals are obtained before work begins.
8. Workmanship Warranty:
Classic Painting & Construction guarantees the quality of workmanship and materials used. Any defects in workmanship reported within 12 months of project completion will be addressed at no additional cost, provided the issue is due to workmanship and not external factors such as environmental conditions or improper maintenance.
9. Liability and Insurance:
Our team is covered by WSIB and maintains all necessary certifications, including WHMIS and fall protection. Classic Painting & Construction is not liable for any pre-existing structural damages or defects found during the project. The Client is responsible for securing and protecting valuables in the work area.
10. Changes to Terms:
Classic Painting & Construction reserves the right to modify these Terms and Conditions at any time. The latest version will always be available on our website or provided upon request.
